Terms and conditions for blood testing and services

Thank you for using Lunarahealth. These terms and conditions describe the use of the website, products and services of Lunarahealth.

Article 1: Who we are

  • Lunarahealth is an initiative of (general) practitioners, based in Rotterdam.
  • We offer medical services such as e-consultations, blood tests, check-ups and other preventive examinations for individuals and businesses.
  • By placing an order with Lunarahealth you confirm that you have read, understood and agreed to these terms and conditions.
  • If you do not agree with these terms, we ask you not to place an order and not to use the services of Lunarahealth.

Article 2: What these terms mean

  • These terms apply to all services of Lunarahealth.
  • By placing an order or making an appointment, you agree to these terms.
  • Lunarahealth: the organisation behind these services.
  • Customer / Patient / you: the person who orders a test or examination or uses one of the services of Lunarahealth.
  • Services: all examinations, blood tests, second opinions and related medical services offered through Lunarahealth.
  • Agreement: the arrangement between you and Lunarahealth.

Article 3: Formation of your order

  • An agreement is formed as soon as you place an order and complete payment.
  • Lunarahealth confirms the order via email.
  • We reserve the right to refuse or cancel orders, for example in the case of incorrect information or suspicion of fraud.
  • Quotes or prices are valid for 14 days, unless otherwise stated.
  • All appointments are confirmed in writing via email.

Article 4: Prices and payment

  • All prices are in euros, including VAT.
  • The listed price includes the collection and order fee.
  • Lunarahealth does not guarantee reimbursement by your health insurer.
  • If you have agreed to pay afterwards, interest and a collection fee may be charged if you do not pay on time.

Article 5: Performance of our services

  • We only start the examination once your payment has been received and we have all necessary information from you.
  • You are responsible for correctly completing your details and questionnaires.
  • An examination time or results deadline is always an estimate.
  • Lunarahealth may collaborate with other doctors, laboratories or phlebotomy points.
  • After payment you have 30 days to schedule an appointment. After that, the invitation expires automatically.
  • After 90 days without an appointment or result, your order will be closed without the right to a refund.

Article 6: Modifying or cancelling appointments

  • You can modify your appointment free of charge up to 24 hours in advance.
  • If you cancel or modify within 24 hours, you pay 50% of the total amount you have paid.
  • If you do not show up for your appointment, the full amount will be charged.
  • Only in cases of force majeure (such as illness, death or pregnancy with medical certificate) may an exception be made.

Article 7: Privacy and confidentiality

  • We treat all data confidentially and in accordance with privacy legislation.
  • Your data will only be shared with third parties if necessary for the examination or legally required.
  • You have the right to access your file.
  • If you have been registered for services of Lunarahealth through another organisation, you have the right to access your file through that organisation.
  • Medical data is stored securely and can be deleted upon request.
  • We do not retain data longer than legally necessary.
  • Complaints about privacy can be submitted to the Dutch Data Protection Authority.

Article 8: Intellectual property

  • All reports, advice and documents you receive through Lunarahealth are intended solely for your personal use.
  • They may not be copied or distributed without permission for commercial purposes.

Article 9: Liability

  • Lunarahealth is not responsible for (the consequences of) results or advice you receive.
  • We do our best to provide accurate information, but medical decisions are always your own responsibility.
  • Lunarahealth is not liable for damage resulting from the use of our services, except in cases of intent or gross negligence.
  • Lunarahealth is not responsible for technical problems beyond our control, such as internet outages.
  • Lunarahealth is not liable for indirect damage, loss of profit or errors by third parties.
  • Liability is limited to the amount covered by our insurance, or otherwise a maximum of €5,000.
  • Lunarahealth may hold you (financially) responsible for damage caused by incorrect information you provide.
  • A complaint or liability claim must be submitted in writing within 14 days of discovery.

Article 10: Force majeure

  • In cases of force majeure (such as disruptions or technical problems) we may temporarily suspend our services.
  • If the force majeure lasts longer than two months, the agreement may be terminated without compensation.

Article 11: Termination

  • Lunarahealth or the customer may terminate the agreement if either party goes bankrupt or ceases operations, or if someone seriously fails to comply with the agreements.
  • Upon termination, you are in principle not entitled to a refund, unless otherwise agreed.

Article 12: Right of withdrawal

  • As a consumer, you have a 14-day cooling-off period for some services.
  • This does not apply to medical examinations or consultations that have already started with your consent.
  • Any refunds will be processed within 14 days of withdrawal.

Article 13: Complaints

  • We have a complaints procedure which can be found on our website.
  • If you have a complaint, please report it as soon as possible via [email protected].

Article 14: Applicable law

  • Dutch law applies to these terms and conditions.
  • Disputes will be handled by the court in Rotterdam.
