Terms and conditions for blood testing and services

Thank you for using Ellymed. These terms and conditions describe the use of the website, products and services of Ellymed.
Article 1: Who we are
- Ellymed is an initiative of (general) practitioners, based in Rotterdam and registered with the Chamber of Commerce under the trade name Ellymed with registration number 89714156.
- We offer medical services such as e-consultations, blood tests, check-ups and other preventive examinations for individuals and businesses.
- We are located in Rotterdam at Westplein 12. This is not a visiting address, except by appointment.
- By placing an order with Ellymed you confirm that you have read, understood and agreed to these terms and conditions.
- If you do not agree with these terms, we ask you not to place an order and not to use the services of Ellymed.
Article 2: What these terms mean
- These terms apply to all services of Ellymed.
- By placing an order or making an appointment, you agree to these terms.
- Ellymed: the organisation behind these services.
- Customer / Patient / you: the person who orders a test or examination or uses one of the services of Ellymed.
- Services: all examinations, blood tests, second opinions and related medical services offered through Ellymed.
- Agreement: the arrangement between you and Ellymed.
Article 3: Formation of your order
- An agreement is formed as soon as you place an order and complete payment.
- Ellymed confirms the order via email.
- We reserve the right to refuse or cancel orders, for example in the case of incorrect information or suspicion of fraud.
- Quotes or prices are valid for 14 days, unless otherwise stated.
- All appointments are confirmed in writing via email.
Article 4: Prices and payment
- All prices are in euros.
- The listed price includes the collection and order fee.
- Ellymed does not guarantee reimbursement by your health insurer.
- If you have agreed to pay afterwards, interest and a collection fee may be charged if you do not pay on time.
Article 5: Performance of our services
- We only start the examination once your payment has been received and we have all necessary information from you.
- You are responsible for correctly completing your details and questionnaires.
- An examination time or results deadline is always an estimate.
- Ellymed may collaborate with other doctors, laboratories or phlebotomy points.
- After payment you have 30 days to schedule an appointment. After that, the invitation expires automatically.
- After 90 days without an appointment or result, your order will be closed without the right to a refund.
Article 6: Modifying or cancelling appointments
- You can modify your appointment free of charge up to 24 hours in advance.
- If you cancel or modify within 24 hours, you pay 50% of the total amount you have paid.
- If you do not show up for your appointment, the full amount will be charged.
- Only in cases of force majeure (such as illness, death or pregnancy with medical certificate) may an exception be made.
Article 7: Privacy and confidentiality
- We treat all data confidentially and in accordance with privacy legislation.
- Your data will only be shared with third parties if necessary for the examination or legally required.
- You have the right to access your file.
- If you have been registered for services of Ellymed through another organisation, you have the right to access your file through that organisation.
- Medical data is stored securely and can be deleted upon request.
- We do not retain data longer than legally necessary.
- Complaints about privacy can be submitted to the Dutch Data Protection Authority.
Article 8: Intellectual property
- All reports, advice and documents you receive through Ellymed are intended solely for your personal use.
- They may not be copied or distributed without permission for commercial purposes.
Article 9: Liability
- Ellymed is not responsible for (the consequences of) results or advice you receive.
- We do our best to provide accurate information, but medical decisions are always your own responsibility.
- Ellymed is not liable for damage resulting from the use of our services, except in cases of intent or gross negligence.
- Ellymed is not responsible for technical problems beyond our control, such as internet outages.
- Ellymed is not liable for indirect damage, loss of profit or errors by third parties.
- Liability is limited to the amount covered by our insurance, or otherwise a maximum of €5,000.
- Ellymed may hold you (financially) responsible for damage caused by incorrect information you provide.
- A complaint or liability claim must be submitted in writing within 14 days of discovery.
Article 10: Force majeure
- In cases of force majeure (such as disruptions or technical problems) we may temporarily suspend our services.
- If the force majeure lasts longer than two months, the agreement may be terminated without compensation.
Article 11: Termination
- Ellymed or the customer may terminate the agreement if either party goes bankrupt or ceases operations, or if someone seriously fails to comply with the agreements.
- Upon termination, you are in principle not entitled to a refund, unless otherwise agreed.
Article 12: Right of withdrawal
- As a consumer, you have a 14-day cooling-off period for some services.
- This does not apply to medical examinations or consultations that have already started with your consent.
- Any refunds will be processed within 14 days of withdrawal.
Article 13: Membership and credits
- The membership is an annual subscription. On purchase and on each renewal you receive 2 credits worth up to €130 each, which you use towards tests at Ellymed.
- If a test costs more than your credit, you pay the difference. If it costs less, the remainder of that credit lapses.
- As a member you receive 15% off tests you buy alongside your credits. A credit and the member discount do not apply together on the same order.
- Your credits remain valid for as long as your membership is active. Unused credits carry over on renewal.
- You expressly ask us to begin your membership immediately so that you can use your credits straight away. You acknowledge that you lose your right of withdrawal for the part of the service already performed.
- If you withdraw within 14 days without having used a credit, we refund the full amount.
- If you have already used a credit within those 14 days, you may still withdraw. We then deduct the standard price of the test performed, up to a maximum of €130 per credit used. If that amount equals or exceeds what you paid, no refund remains.
- After the 14-day cooling-off period the annual fee is not refunded. Your membership continues until the end of its term.
- After the first year your membership renews automatically. You may then cancel on a monthly basis; we refund the remaining part of the annual fee pro rata.
- You can manage or cancel your membership at any time from your profile. If you cancel, your credits remain usable until the end of the paid period; unused credits lapse thereafter.
Article 14: Complaints
- We have a complaints procedure which can be found on our website.
- If you have a complaint, please report it as soon as possible via [email protected].
Article 15: Applicable law
- Dutch law applies to these terms and conditions.
- Disputes will be handled by the court in Rotterdam.
